Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Pixelglass, including the website at pixelglass.co and the application at app.pixelglass.co (together, the "Service"). The Service is operated by Klementine Ventures LLC, a limited liability company incorporated in the State of Wyoming, United States ("Klementine Ventures," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pixelglass is a tool that helps you build and refine themes for the Ghost publishing platform by describing what you want in plain language. Themes produced by the Service are standard Ghost themes that you may download, keep, and use with or without the Service. You are responsible for reviewing and testing any output before publishing it to a live site.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You agree to provide accurate account information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Credits, pricing and payment

The Service is offered on a one-time credit-pack basis. You purchase credits up front; there is no subscription. Credits are consumed as you use the Service, metered by the work performed — larger tasks consume more credits than small ones. Unless stated otherwise, purchased credits do not expire. All prices are in US dollars and exclude any applicable taxes, which are your responsibility. Payments are handled by third-party payment processors; by purchasing, you also agree to their terms.

4. Refunds

Credits that have been consumed are non-refundable. If you believe you were charged in error or experienced a technical problem, contact us at ronald@pixelglass.co and we will review your request in good faith.

5. Your content and ownership

You retain ownership of the prompts, text, and other materials you submit ("Your Content"), and of the Ghost themes the Service generates for you. You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely to operate, secure, and improve the Service. You are responsible for ensuring you have the rights to any content you submit and that it does not infringe the rights of others.

6. Acceptable use

You agree not to misuse the Service. In particular, you will not: use the Service for any unlawful purpose; attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service; use it to generate content that is illegal, infringing, or harmful; or resell or attempt to resell the Service itself. We may suspend or terminate access for conduct that breaches these Terms.

7. Intellectual property

The Pixelglass name, brand, website, and underlying software are owned by Klementine Ventures LLC and are protected by applicable laws. These Terms do not grant you any right to our trademarks or software except as needed to use the Service. Ghost is a trademark of the Ghost Foundation; Pixelglass is an independent product and is not affiliated with or endorsed by the Ghost Foundation.

8. Third-party services

The Service relies on third parties, including the Ghost platform, payment processors, and artificial-intelligence providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. Output is generated with the assistance of automated systems and may contain errors; you are responsible for reviewing and testing it before use. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, Klementine Ventures LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Klementine Ventures LLC and its members and affiliates from any claims, damages, or expenses arising out of your use of the Service, Your Content, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Themes you have already downloaded remain yours.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
